Do you have or use a checklist of documents/forms a dealer needs to provide a customer in order to be Red Flag Compliant? i.e. Privacy notice, risk base, adverse action etc.

Hi Jim,

 

Here is a basic list. Each of these items represent a different regulation and dealer personnel should be trained in their necessity/usage:

Privacy Notice (updated format should be used as of 1/1/11)

Risk based Pricing Notice or Credit Score Disclosure (recommended)

Adverse Action Notice

OFAC report

Cash reporting

 

Let me know if you need any specific info about each.

Thanks Jim. How are dealers going about getting service provider addendum from their venders. Is it a separate form/agreement or are they providing a copy of their ITPP???

I would recommend getting a copy of their ITPP.
